Notice pay (ihbar tazminatı) is compensation owed in Turkey when an open-ended employment contract is terminated without observing the statutory notice periods in article 17 of the Labour Law. It works in both directions: an employer who dismisses an employee without granting notice pays the employee, and an employee who quits without giving notice owes it to the employer. The rules apply to foreign employees working under Turkish law the same way as to Turkish nationals. This tool uses the 2026 parameter set to find the notice period that matches your length of service, then shows gross notice pay and the net amount after income tax and stamp duty.

How is it calculated?

  1. Total service is converted to months: years × 12 + months.

  2. The notice period is read from the statutory table:

    • Under 6 months of service: 2 weeks
    • 6 to 18 months: 4 weeks
    • 18 to 36 months: 6 weeks
    • 36 months and above: 8 weeks

    The lower bound is inclusive and the upper bound exclusive: an employee with exactly 6 months of service falls into the 4-week band.

  3. The daily wage is one thirtieth of the monthly gross; gross notice pay = daily wage × 7 × number of weeks. The base is the benefit-inclusive gross wage: regular bonuses, premiums, and meal and transport allowances are counted on top of the base salary.

  4. Income tax is deducted at the bracket rate you select. The bracket choice is a user assumption: the rate applied on a real payslip depends on your cumulative taxable income accrued since January, which this tool cannot know.

  5. Stamp duty (0.76%) is deducted from the gross amount.

  6. Net notice pay = gross − income tax − stamp duty. No social security premium is withheld from notice pay.

Frequently asked questions

How long is the notice period in Turkey?

Between 2 and 8 weeks, depending on length of service, under article 17 of the Turkish Labour Law. Service under 6 months requires 2 weeks of notice, and the period rises in steps to 8 weeks once service reaches 36 months. These are legal minimums; an employment contract may set longer periods but not shorter ones.

Who pays notice pay in Turkey?

The party that terminates an open-ended employment contract without observing the notice period pays the other party. If the employer dismisses without notice, it pays the employee; if the employee resigns without notice, the employee owes it to the employer. No notice pay arises in immediate terminations for just cause (Labour Law articles 24–25).

Is notice pay calculated on gross or net salary?

On gross salary — specifically the benefit-inclusive gross wage. Gross notice pay is computed first from the daily benefit-inclusive wage, and income tax and stamp duty are then deducted to reach the net amount.

What is deducted from notice pay in Turkey?

Income tax and stamp duty; no social security premium is withheld. Unlike severance pay, notice pay is not exempt from income tax, so the net amount is noticeably lower than the gross.

Why do I choose the income tax bracket myself?

Because the rate that applies to notice pay depends on your cumulative taxable income accrued since the start of the year, and the tool cannot see your payroll history. Your selection is an assumption: terminations early in the year usually fall into the lowest bracket, while later in the year higher brackets often apply. The exact figure is settled on the payslip your employer issues.

Can the employer pay wages instead of granting the notice period?

Yes — the employer can choose either route: grant the notice period and let the employee work through it (with paid job-search leave of at least two hours per day), or pay the wages for the notice period upfront and terminate immediately. If the notice period is properly granted, no separate notice pay is owed.

Does notice pay apply during a probation period?

No — if the contract contains a written probation clause, either party may terminate during probation without notice and without compensation. Without a written probation clause, the statutory notice periods apply from the first day, starting with the shortest band in the table.
